Terms of Service
Last updated: 27 October 2026
1. About these Terms
These Terms are the agreement between you and Sam Lewis (trading as SOL Quoting) (ABN 63 863 607 253), a sole trader basedon the Gold Coast, Australia (“Estimate”, “we”, “us”), for the use of the Estimate website and app (the “Service”). “You” means the business that signs up, and the person signing up for it.
You accept these Terms when you tick the box at sign-up or use the Service. Please read them, along with our Privacy Policy. If anything is unclear, email us at support.estimate@gmail.com.
2. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or compensation for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
These guarantees usually apply to businesses too, because the Service costs less than $100,000. Nothing in these Terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can’t lawfully be excluded. If any part of these Terms seems to say otherwise, the law wins.
3. What Estimate does
Estimate reads floor plans you upload, works out measurements and quantities, prices them from rates you set, and helps you put together and send quotes to your own clients. It is a tool for preparing quotes. It does not give surveying, engineering, building, legal, tax or financial advice.
4. Your account
- You must be at least 18 and allowed to act for the business you sign up.
- Keep your account details accurate and your password private. You’re responsible for what happens in your account, unless it’s caused by our failure to keep the Service secure.
- Tell us straight away if you think someone else has got into your account.
5. Free trial, price and billing
Free trial
- New accounts start with a 14-day free trial of the Pro plan, which includes 5 quotes in total.
- You need to add a payment card (collected by Stripe) to start the trial. Nothing is charged during the trial.
- Unless you cancel before the trial ends, the trial turns into a paid Pro subscription and your card is charged A$89 on day 15, then A$89 every month after that until you cancel. The billing page in the app shows the exact date your card will be charged.
- You can end the trial early by choosing “Start my plan”. Your card is charged that day.
- Each business can have one free trial.
Price
- The Pro plan costs A$89 a month, charged in advance each month on the same date, until you cancel. The Business plan (A$199 a month) isn’t on sale yet; we’ll update these Terms before it is.
- GST: Estimate isn’t registered for GST, so no GST is included in or added to our price. Our Stripe receipts and invoices are not tax invoices, and you can’t claim a GST credit for our fees. If we register for GST, we’ll tell you before it changes anything you pay (see “Price changes” below).
- Stripe processes all payments. Card details go to Stripe, not to us.
Quote limits
- The free trial includes 5 quotes in total. The Pro plan includes up to 10 new quotes a week. The weekly count resets every Monday at 12:00am in your business’s time zone (Melbourne time unless you set another).
- Every new quote counts, including copies of a quote and quotes made without a floor plan. Deleting a quote doesn’t give it back. Editing, sending and downloading quotes you’ve already made isn’t limited.
Failed payments
If a payment fails, Stripe will try again and we’ll let you know. While a payment is overdue, you may not be able to use the Service until it’s paid. Your quotes and rates are kept.
Price changes
We may change our prices. If we do, we’ll email you at least 30 days before the new price applies to you. It applies from your first billing date after that notice period, never to a month you’ve already paid for. If you don’t want to pay the new price, cancel before it applies. There’s no fee for cancelling.
6. Cancelling and refunds
- You can cancel at any time in the app: Settings → Billing & plan → Manage billing → Cancel subscription. If you can’t get in, email support.estimate@gmail.com and we’ll cancel it for you. There’s no cancellation fee and no lock-in.
- Cancel during the free trial and you won’t be charged anything.
- After the trial, cancelling stops the next payment. You keep access until the end of the month you’ve paid for.
- We don’t give refunds for a change of mind or for part of a month you didn’t use. But you will get a refund if:
- you’re entitled to one under the Australian Consumer Law (see clause 2);
- we charged you by mistake; or
- we end the Service, or make a change that significantly reduces what your plan includes (clauses 14 and 16), in which case we’ll refund the part of any month you’ve paid for but can’t use.
- To ask for a refund, email support.estimate@gmail.com.
7. Plan reading uses AI: check every quote
Estimate uses artificial intelligence (Anthropic’s Claude models) to read floor plans and price lists. The rooms, measurements and quantities it reads, and the prices worked out from them, are estimates. They can be wrong, for example when a plan is unclear, not to scale, missing dimensions or unusual. Starter rates, sample prices and default inclusions and exclusions are examples only, not advice about what you should charge or include.
Before you send or rely on a quote, check it. Compare room sizes with the drawing, look for missing or doubled-up rooms, and check quantities, rates, inclusions, exclusions and the total. You decide what goes in a quote and what price you offer your client.
This doesn’t reduce our obligations under the Australian Consumer Law: we must supply the Service with due care and skill, and if we don’t, you have the rights in clause 2.
8. Your quotes and your clients
- Quotes you send are offers from your business to your client. Any contract formed when a client accepts (online or otherwise) is between you and your client. Estimate is not a party to it.
- You’re responsible for making sure your quotes and contracts meet the laws that apply to you, such as trade licensing, home building and domestic building contract laws, and consumer laws. In some states and territories, residential building work over a set value needs a written, signed contract with set contents. A client accepting a quote online may not be enough on its own.
- Whether your quotes show GST, and any tax invoices you issue to your clients, are your matter. Estimate shows GST on quotes using the settings you choose (for example, whether you’re registered for GST); check they’re right for your business.
9. Messages to your clients (Spam Act)
Quote links, follow-up texts and follow-up emails go to your clients in your business’s name. You are the sender of these messages for the purposes of the Spam Act 2003 (Cth), including emails Estimate delivers for you, such as quote emails and automatic follow-ups. You agree to:
- only send quotes and follow-ups to people who asked you for a quote or have otherwise agreed to hear from you;
- make sure each message identifies your business and how to contact you. Emails Estimate sends for you include your business name, your contact details and a line telling the client they can reply to stop. Texts you send from your own phone are yours to word: include your business name and, in follow-ups, a way to opt out (for example, “Reply STOP and I won’t follow up again”);
- stop within 5 working days when a client asks you to: tap Stop reminders on that quote in Estimate and don’t follow up by text or email again; and
- not use Estimate to send marketing messages to people who haven’t agreed to receive them.
10. Your clients’ personal information
You decide what client details (such as names, phone numbers, email addresses and job addresses) go into Estimate. You’re responsible for collecting them lawfully and for telling your clients how you handle their information, including that you use service providers like Estimate. We handle your clients’ information on your behalf, only to provide the Service to you and as set out in our Privacy Policy. We don’t sell it or use it for our own marketing. If we become aware of a data breach that affects your clients’ information, we’ll tell you promptly.
11. Your content
- You keep ownership of the floor plans, client details, rates, logos and quotes you put into Estimate (“your content”).
- You give us permission to store, process, copy and display your content only as needed to run the Service for you, including sending it to the service providers listed in our Privacy Policy. We don’t use your content to train AI models.
- You must have the right to upload your content. Plans drawn by an architect or builder may be protected by copyright; uploading them to price a job you’ve been asked to quote is your responsibility.
- You can download your quotes as PDFs or spreadsheets at any time while your plan is active.
12. Fair use
You agree not to:
- upload content you don’t have the right to use, or that is unlawful;
- try to break into, disrupt, overload or copy the Service, or get around its quote limits;
- resell the Service or use it to build a competing product without our written agreement; or
- use the Service for anything unlawful, including misleading your clients.
13. Our intellectual property
The Service, including its software, design and branding, belongs to Sam Lewis (trading as SOL Quoting) and its licensors. You get the right to use the Service while your plan is active, and nothing more. Quotes and PDFs you make with Estimate are yours to use in your business.
14. Changes to the Service and availability
- We keep improving Estimate, so features will change over time.
- If we plan a change that significantly reduces what your plan includes (for example, a lower weekly quote limit or removing plan reading), we’ll email you at least 30 days before it happens. You can cancel before then and we’ll refund the part of any month you’ve paid for but can’t use.
- We may need to make a change sooner for security, to follow the law, or because a supplier we rely on changes or withdraws its service. If so, we’ll tell you as soon as we can, and the same refund applies.
- We work to keep Estimate running but it may sometimes be unavailable, for example during maintenance or an outage at one of our providers. We’ll try to give notice of planned maintenance.
15. Liability
- Clause 2 comes first: nothing in this clause limits your rights under the Australian Consumer Law that can’t be limited.
- Where the law allows (section 64A of the Australian Consumer Law), if we fail to meet a consumer guarantee our liability is limited to supplying the Service again or paying the cost of having it supplied again, unless it wouldn’t be fair or reasonable for us to rely on this limit.
- Otherwise, and as far as the law allows, our total liability to you for all claims about the Service in any 12-month period is limited to the fees you paid us in that period.
- Neither of us is liable to the other for indirect or consequential loss, or for lost profits, revenue or business opportunities, except where the law doesn’t allow this to be excluded.
- Neither of us is liable for loss to the extent the other caused it. For example, we’re not liable for loss caused by a quote you sent without checking it as clause 7 asks.
- These limits don’t apply to loss caused by fraud or wilful misconduct.
16. Ending the agreement
- You can end it at any time by cancelling (clause 6). To close your account and have your data deleted, email support.estimate@gmail.com.
- We can suspend or close your account straight away if you use the Service unlawfully, put its security or other users at risk, or seriously breach clauses 9 or 12. For any other breach of these Terms, we’ll tell you what’s wrong and give you at least 14 days to fix it first.
- We can also stop offering the Service by giving you at least 30 days’ notice by email, and we’ll refund the part of any month you’ve paid for but can’t use.
- If your plan ends, your content stays in your account in case you come back, until you ask us to delete it or we delete inactive accounts. We’ll email you at least 30 days before deleting an inactive account’s data, so you can ask us for a copy first.
- Clauses 2, 10, 11, 15 and 18 keep applying after the agreement ends.
17. Changes to these Terms
We may update these Terms, for example to cover new features, reflect changes in the law or make them clearer. If a change is likely to be worse for you, we’ll email you at least 30 days before it takes effect and explain what’s changing. You can cancel before then with no fee, and we’ll refund the part of any month you’ve paid for after the change. Other changes take effect when we publish them here and update the date at the top. Changes never apply to anything that happened before they took effect. If you keep using Estimate after a change takes effect, the updated Terms apply.
18. Disputes and governing law
- If something goes wrong, please email support.estimate@gmail.com first. We’ll try to sort it out with you within 30 days. This doesn’t stop either of us going to a court, tribunal or regulator (such as the ACCC, your state or territory fair trading agency, or a small business commissioner).
- These Terms are governed by the law of Queensland, Australia. The courts of Queensland, and the courts that hear appeals from them, can decide disputes about these Terms, and either of us can also bring a dispute in any other Australian court or tribunal that has jurisdiction, including one in your own state or territory.
- We provide the Service to businesses in every Australian state and territory. Nothing in these Terms limits your rights under the Australian Consumer Law, or any law of the state or territory where your business is based that can’t lawfully be excluded, restricted or modified.
19. General
- If part of these Terms can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we haven’t given it up.
- We send notices to the email address on your account. You can send notices to support.estimate@gmail.com.
